By-law 10: The research fund

Part 1: Establishment of fund
1. Pursuant to the objects of the Australian Library and Information Association ('the Association') as set forth in its constitution and to its powers, there shall be established a fund of moneys to be known as the Australian Library and Information Association Research Fund ('the fund').
Part 2: Objects of the fund

  1. The fund is established for the purposes set forth in sub-para (c) of this paragraph.
  2. Members of the Association and of the Australian public shall be actively encouraged to participate in the fund.
  3. The fund shall be applied exclusively to the funding of research activities by the Association having the following characteristics, namely:
    1. Rigorous scientific analysis and measurement of the subject matter of the research undertaken by the Association with funds from the fund;
    2. Identifying and assessing the economic, social and cultural benefit to the Australian community of the scientific research undertaken by the Association with funds from the fund;
    3. Undertaking research into all aspects of library and information science, being the technology and developments in methodologies for the organistaion of information and knowledge, including but not limited to the provision, retrieval, production and use of information, research into and quantifiable analysis of information and technology, and research into and quantifiable analysis of the activities, methods and research activities and results undertaken by various information agencies and libraries throughout Australia;
    4. Undertaking research into the organisation, management and dissemination of information, technology and recent scientific developments in order to facilitate their efficient and timely application to practical use in the Australian community and economy by groups and bodies desirous of making such practical applications of that information, technology and recent scientific developments;
    5. Undertaking research into and quantifiable analysis of the activities referred to in by-laws 2 (c) (iii) and (iv) above, and also into the professional practice of library and information science in Australia, and thereafter extending the knowledge of information agencies and libraries throughout Australia by disseminating the knowledge represented by the results of that research and that analysis obtained by the Association to various information agencies and libraries throughout Australia.
Part 3: The fund
3. A donor of a gift to the fund and for which an income-tax deduction is sought must acknowledge in writing that the gift is made for the purposes of research in accordance with the objects of the fund as set out in 2(c).
4. All gifts must be paid into the fund.
5. The fund shall be subject to independent annual audit.
6. The fund shall not be used for the purposes of provision of scholarships for students, the organisation of conferences, congresses and symposiums or the publication of information other than the results of the Association's research.
7. The Association shall review the Approved Research Institute status on a yearly basis and comply with all requirements of the Australian Taxation Office and relevant legislation and regulations.
Part 4: The committee
8. The fund shall be administered on behalf of the Association's Board of Directors by a committee ('the committee') comprising no less than five members, the majority of whom shall be suitably-qualified for assessing the relevant area of research.
9. The committee has the power to determine the research activities that are to be funded from the fund account subject to the provisions of paragraph 2(c).
10. The committee may seek to raise moneys for the fund by gifts, donations and bequests from such sources as it may consider appropriate.
11. The committee will have sole jurisdiction over the application of moneys for research.
12. The membership of the committee will be subject to the approval of the relevant approving authority.
13. The committee shall encourage publication of funded research activities in the Association's journals and more widely.
14. In no case shall the fund or any proceeds be applied by the committee in any manner inconsistent with the objects and powers of the Association.
15. No payments shall be made from the fund other than payments in respect of research activities, or in meeting costs associated with the conduct of the fund.
16. The committee shall elect its chair from amongst its members.
17. The committee shall meet at least once in every year and subject thereto at such times as the committee shall from time to time determine and include electronic meeting and voting.
18. The quorum for a meeting of the committee shall be three.
19. Any determination of the committee in respect of the fund made in accordance with this by-law shall be valid and effective as if made by the Board in accordance with the constitution.
20. A nominated employee of the Association shall attend all meetings of the committee and may be heard on any matter but shall not be entitled to vote.
21. The committee shall report annually to the Association's Board of Directors.
Part 5: Accounts
22. The committee shall keep proper accounts with respect to the fund and all moneys received by and for the purposes of the fund and expended from the fund.
23. Moneys standing to the credit of the fund may be invested by the Association in securities in accordance with the Association's constitution.
24. Interest accruing to the fund may be disposed of in defraying costs associated with the conduct of the fund, and funding research.
25. The Association's Board of Directors may delegate the day-to-day management of the fund accounts to the executive director.
26. A receipt for a tax-deductible gift must state the information specified to be included under income-tax law.
Part 6: Winding up the Fund
27. In the event of the Fund being wound up, any surplus assets remaining after the payment of the Fund's liabilities shall be transferred to the research fund account of another organisation in Australia which has been endorsed as an Approved Research Institute for the purposes of the Income Tax Assessment Acts.
